Once a name or other trademark is abandoned, it’s fair game for anyone else to pick it up and make it their own. In the 1960’s when Pontiac cars no longer wanted to use their trademarked outline shape of the Indian Chief Pontiac’s head, they feared some other company would use it and confusion would result; so for several years, they kept using it, but only as the outline for the hi-beam headlight indicator light on the dashboard where it was hardly noticed.

So Sea King – not used since Montgomery Wards folded up, was fair game for anyone to grab and use as their trademark. It could be argued that it’s false advertising to compare the new ones to the reputation of the old though like the website does.
