I would like to put a new circuit breaker on my CMC power tilt and trim unit.
The original circuit breaker is 24 VDC 40 amp and is hooked up to one 12 volt battery.
Can I use 12 volt 40 amp circuit breaker instead?

That 12V circuit breaker will be fine. I have that exact 12V 40amp breaker on the hydraulic jack plate on my 150 Evinrude.

I guess bob’s experience says it is ok, but we don’t really have enough information. For instance, there is a difference in the load type to consider. An inductive load (motors) is a lot harder on switches than a resistive load (lights)

Good point Frank. The entire circuit must be properly sized – switch, breaker and wiring.
